Photography Service Agreement and Terms of Use for Isabel Schilling Photography These terms are intended as a professional starting point for event photography such as prom, dances, and parties, plus portrait photography such as seniors, minis, and related sessions in Northwest Indiana. They should be reviewed by a qualified attorney before being used as a binding legal agreement. 1. Scope of Services. Isabel Schilling Photography will provide the photography services described in the selected package and confirmed session notes. Final services may include planning guidance, photography coverage, image selection, professional editing, digital gallery delivery, and optional print or product recommendations. 2. Booking, Retainers, and Payment. A session is not confirmed until Isabel Schilling Photography accepts the booking request and any required retainer, deposit, or invoice payment has been completed. Retainers compensate the photographer for reserving the date, preparation time, and turning away other work. Remaining balances are due according to the invoice or written confirmation provided to the client. 3. Rescheduling and Cancellation. Clients should request schedule changes as early as possible. Weather-related or safety-related rescheduling may be recommended by the photographer. Client cancellations, no-shows, or late arrivals may result in forfeiture of the retainer or reduced shooting time. If the photographer must reschedule because of illness, emergency, unsafe conditions, or circumstances beyond reasonable control, the photographer will make a good-faith effort to provide a new date. 4. Copyright and Artistic Ownership. All photographs, edits, compositions, and image files remain the copyrighted intellectual property of Isabel Schilling Photography. Clients receive a personal-use license for delivered images unless a separate commercial license is agreed to in writing. Clients may not sell, alter, apply filters to, submit for publication, or use images commercially without written permission. 5. Editing Style and Creative Discretion. The client acknowledges that photography is an artistic service. Isabel Schilling Photography retains discretion over posing, composition, lighting, image selection, color treatment, retouching, and final gallery presentation. Raw, unedited files are not included unless expressly stated in writing. 6. Image Delivery and Archive Retention. Edited images will be delivered through an online gallery or another agreed method. Delivery timelines may vary based on session type, season, volume, and editing needs. Clients are responsible for downloading and backing up delivered images. Galleries and archives may be removed after a reasonable period, and long-term storage is not guaranteed unless separately purchased or agreed. 7. Model Release and Promotional Use. Unless the client opts out in writing before the session, the client grants Isabel Schilling Photography permission to use selected images for portfolio, website, social media, studio samples, competition, publication, and other business promotion. Sensitive sessions, minors, and private events may be handled with additional discretion upon written request. 8. Client Cooperation and Session Conditions. The client is responsible for arriving on time, securing needed permissions for locations, coordinating participants, preparing wardrobe or props, and supervising children, pets, or guests. The photographer is not responsible for missed images caused by late arrivals, uncooperative participants, restricted venues, poor weather, wardrobe issues, or circumstances outside the photographer's control. 9. Safety, Weather, and Location Permissions. The photographer may decline or stop services when conditions appear unsafe, unlawful, or professionally unreasonable. Clients are responsible for any permits, access fees, parking fees, or location-specific restrictions unless otherwise agreed. 10. Limitation of Liability. If services cannot be completed because of equipment failure, illness, emergency, force majeure, data loss, or circumstances beyond reasonable control, liability is limited to amounts paid by the client for the affected service. The photographer is not liable for consequential, incidental, or indirect damages. 11. Payment Processing and Receipts. Online checkout is currently deferred. If payment is enabled later, payment processing should be handled through a secure third-party provider and provider receipts may be issued automatically after successful payment. Isabel Schilling Photography may also issue invoices, balance reminders, or manual confirmations as needed. 12. Acceptance. By checking the agreement box and submitting a booking request, the client confirms that they have read, understood, and agree to these terms as part of the booking process.
